Welcome to PayStudy.in (hereinafter referred to as "the Website"). The Website is owned and operated by PayFX Fintech Solutions Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at No - 1047A, Z-16, Trichy Road, Ramanathapuram, Coimbatore 641045.

By accessing or using this Website, you agree to be bound by the following Terms and Conditions of Use (hereinafter referred to as the "Terms" or "TOU"). If you do not agree to these Terms, you may not access or use this Website.
This document is an electronic record under applicable law and does not require physical or digital signatures.

1. DEFINITIONS

For the purposes of these Terms and Conditions, the following expressions shall have the meanings ascribed to them below, unless the context otherwise requires:

  2. Intending Borrower
    Any individual or institution seeking financial assistance for education-related expenses who has registered and created an account on the Website.
  3. Intending Lender
    Any individual or institution interested in offering loans or other forms of financial assistance to Intending Borrowers and duly registered as a Lender on the Website.
  4. User
    Any person who accesses, browses, or uses the Website in any manner, including but not limited to Intending Borrowers and Intending Lenders.
2. WHAT WE DO

PayStudy is a platform that facilitates communication between individuals and institutions looking to borrow funds for educational purposes and those looking to lend. We are not a bank, financial institution, or credit rating agency.

We do not guarantee that any borrower will obtain funding or that any lender will find a creditworthy borrower.

3. FEES AND CHARGES

PayStudy charges a fee only when a user enters into an agreement to lend or borrow funds.

  • If the lender is a financial institution, such as a bank, we charge no fees from the borrower. We receive a commission directly from the lender via a corporate agreement.
  • If the lender is an individual or non-financial entity, the fee structure may differ and could be shared between both parties. This may change without prior notice.
4. SAMPLE AGREEMENTS

Sample formats for borrower-lender agreements may be provided on the Website. Use of these formats is optional and users may adopt agreements of their own choice.

5. LEGAL ADVICE

We strongly recommend all users consult with an independent legal professional before entering into any agreement or transaction facilitated by PayStudy.

6. USER RESPONSIBILITIES
  • We do not vouch for the credibility or creditworthiness of any user.
  • PayStudy does not act as an agent for any party.
  • We do not charge any upfront processing, insurance, or evaluation fees from borrowers. If someone demands such fees in our name, please notify our Grievance Officer immediately.
7. DISCLAIMER

PayStudy is not:

  • A bank or financial institution
  • An investment advisor
  • A guarantor or credit rating agency
  • A credit information company
  • A verification or intermediary service

Use of this Website is entirely at your own risk.

8. LICENSE AND ACCESS

We grant users a limited license to access and use the Website for personal, non-commercial purposes. You may not download, copy, frame, modify, or use any content for commercial gain without express written permission.

9. MODIFICATION OF TERMS

PayStudy reserves the right to amend these Terms, policies, and pricing at any time without prior notice. Continued use of the Website signifies your acceptance of such changes.

10. USER ACCOUNTS

You are responsible for safeguarding your account credentials. Notify us immediately of any unauthorized use. We reserve the right to restrict access or terminate accounts as necessary.

11. ACCEPTABLE USE POLICY

You agree not to use the Website:

  • For illegal, fraudulent, or malicious activities
  • To post objectionable content (including racist, obscene, defamatory, or misleading content)
  • To disrupt, hack, or gain unauthorized access to systems
  • To impersonate others or misrepresent yourself

We reserve the right to remove any content violating these terms.

12. CONTENT RIGHTS

By submitting any content to the Website, you grant PayStudy and its affiliates a non-exclusive, royalty-free, perpetual license to use, display, and distribute the content globally.

You also confirm that you own or control all rights to such content and agree to indemnify us against claims from third parties arising from your content.

13. INTELLECTUAL PROPERTY

All content on the Website (text, logos, graphics, data, software, etc.) is the property of PayFX Fintech Solutions Private Limited or its partners and is protected by applicable intellectual property laws.

14. LIMITED LIABILITY

PayStudy, its parent company (PayFX Fintech Solutions Private Limited), directors, employees, or affiliates shall not be liable for:

  • Loss of data, revenue, or indirect damages
  • User-generated or third-party content
  • Breach of agreements between users
15. INDEPENDENT AGREEMENTS

Any agreement entered into between a borrower and lender is entirely bipartite. PayStudy is not a party to such contracts and disclaims all liability arising therefrom.

16. COMMUNICATION

By providing your contact information, you consent to being contacted by us via email, SMS, phone, or other channels.

17. INDEMNIFICATION

You agree to indemnify and hold harmless PayStudy and PayFX Fintech Solutions Private Limited from any claims, damages, or losses arising from your use of the Website or breach of these Terms.

18. ELIGIBILITY

Use of the Website is only available to individuals who can form legally binding contracts under the Indian Contract Act, 1872.

19. FORCE MAJEURE

We are not liable for any delay or failure resulting from causes beyond our reasonable control.

20. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.

21. ENTIRE AGREEMENT

These Terms constitute the full agreement between you and PayStudy. They supersede any prior agreements or understandings.

23. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by the laws of India. Any disputes shall be subject to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the sole arbitrator appointed by PayFX Fintech Solutions Private Limited. Courts at Coimbatore, Tamil Nadu shall have exclusive jurisdiction.

24. NON-COMPLIANCE

Violation of these Terms may result in account suspension, termination, or legal action.
